We recognize the concerns and uncertainty that recent federal immigration policy changes and enforcement actions may cause, both for individuals directly affected and for their families, whether here in the U.S. or abroad. TCU shares in these concerns and continues to monitor developments closely.

Presidential Proclamation Introduces Major Change to H-1B Visa Program

On September 19, 2025, the White House issued a Presidential Proclamation introducing a significant change to the H-1B visa program. Effective September 21, 2025, U.S. employers must pay a $100,000 fee for each new H-1B petition submitted, with limited exceptions for cases deemed to serve the national interest. This requirement will remain in effect for one year, through September 21, 2026. You can read the full Presidential Proclamation here.

Since the proclamation’s release, federal agencies have issued preliminary guidance outlining how the fee will apply. The following points have been confirmed:

  • The $100,000 fee applies only to new H-1B petitions submitted on or after September 21, 2025.
  • Petitions filed before midnight on September 21, 2025 are not subject to the new fee.
  • The proclamation does not affect existing H-1B visa holders, nor does it limit their ability to travel internationally.
  • The policy does not retroactively apply to previously approved H-1B visas.

Several important questions remain, and we are actively seeking further clarity on the potential implications of this proclamation. We are closely monitoring updates from federal agencies and will continue to share relevant information with the campus community as it becomes available.

Departments wishing to sponsor international employees for H-1B status should continue to coordinate directly with the International Services Office (ISO). Our office will provide case-specific guidance and ensure compliance with all federal requirements during this evolving policy period.

Important Nonimmigrant Visa Interview Scheduling Requirements

Effective September 6, 2025, the U.S. Department of State (DOS) now requires non-immigrant visa applicants to schedule their visa interview appointments at a U.S. Embassy or Consulate located in their country of nationality or residence. Individuals from countries where the United States does not maintain visa operations must apply at a designated U.S. Embassy or Consulate in another country. An updated list of affected countries was published on October 10, 2025. To ensure accuracy and avoid delays, applicants should refer directly to the U.S. Department of State for the most current information and instructions.
